Maison Lançon
1. Services and Compensation
Maison Lançon will provide the services specified in the Statement of Work (“Deliverables”) to Client on the terms and conditions specified in these Terms. Client agrees to pay all fees outlined in the applicable invoice or proposal. All fees are non-refundable unless otherwise expressly stated in this agreement.
Timeline
Initial design concepts will be delivered within 5-10 business days following receipt of payment and all required project details. Any projected timelines for design, production, or delivery are estimates only and are based on timely client communication, prompt approvals, and standard production conditions. Maison Lançon shall not be held liable for delays resulting from:
- Client response time or delayed approvals
- Changes to design scope
- Material or stone availability
- Third-party manufacturing timelines
- Shipping carrier delays or disruptions
- Any other delays outside of its direct control
Production & Pricing
Following design approval, a final production quote will be provided. Production will not begin until the final design is approved and the production invoice is paid in full.
Refund and Return Policy
Due to the custom nature of the work, all design fees are non-refundable. Manufacturing orders are final and non-cancelable once submitted to production.
2. Term; Termination
Term
The agreement remains in effect until the completion of services unless otherwise terminated in writing.
Cancellations
Clients may cancel the project at any time prior to the commencement of the manufacturing phase. In such cases, the client will be responsible for payment of all design work completed up to the date of cancellation, calculated based on Maison Lançon’s hourly design rate of $75/hr. Any outstanding balance for design services will be invoiced and due upon receipt.
Production Phase (No Cancellation)
Once the design has been approved and the project has entered the manufacturing/production phase, the order is considered final and may not be canceled. At this stage, the full manufacturing balance becomes due under net-30 terms, beginning from the date the order is submitted to the manufacturer.
General Cancellation Terms
Clients may choose not to proceed with manufacturing through Maison Lançon; however, design work completed will be billed accordingly, and design files will not be released unless purchased separately.
3. Ownership
Designs
All designs remain the intellectual property of Maison Lançon until full payment is received. Design files are not released unless purchased separately. Design files (including CAD/STL files) are not included in the design fee and will not be released for external manufacturing unless purchased separately under a separate agreement.
Deliverables
All designs, sketches, renderings, CAD files, and related materials (“Deliverables”) created by Maison Lançon remain the sole intellectual property of Maison Lançon. Upon full payment for design services, the client is granted a limited, non-transferable, non-exclusive license to review and approve the design solely for the purpose of manufacturing the piece through Maison Lançon.
Design files, including but not limited to CAD or STL files, are not included and will not be released for external use, reproduction, or manufacturing unless purchased separately under a separate agreement. The client may not reproduce, modify, distribute, or manufacture the design outside of Maison Lançon without prior written consent. Maison Lançon reserves the right to use all Deliverables for portfolio, marketing, and business purposes.
4. Limited Warranty
Maison Lançon provides a one (1) year limited warranty from the date of delivery on all completed pieces manufactured through its third-party partners. This warranty covers: material defects or workmanship issues, significant discrepancies between the final piece and the client-approved design, and one (1) standard resizing, where applicable.
If a covered issue arises, Maison Lançon will coordinate repair or correction with its third-party manufacturer, including arranging expedited shipping where reasonably possible. This warranty does not cover: normal wear and tear, accidental damage, misuse, or improper care, third-party alterations or repairs, loss or theft, or damage to client-supplied stones or materials.
All warranty claims must be submitted within the one (1) year period and may require inspection prior to approval. Maison Lançon’s responsibility under this warranty is limited to facilitating repair or correction through its manufacturing partners and does not guarantee specific timelines or outcomes.
5. Limited Warranty; Disclaimer
Maison Lançon will provide services in a professional manner. Due to the subjective nature of design, aesthetic preferences do not constitute grounds for refund.
6. Limitation of Liability
Maison Lançon is not responsible for variations that may occur during production due to material properties, stone availability, or manufacturing processes. Additionally, Maison Lançon is not liable for indirect or consequential damages. Total liability shall not exceed the amount paid by the client.
7. General
This agreement constitutes the entire agreement between the parties and is governed by the laws of the State of New York.
This statement of work (“Statement of Work”) and the Service Terms and Conditions attached hereto (collectively, the “Agreement”) is entered into by and between the client specified in the Statement of Work (“Client”) and Maison Lançon LLC. By signing this Service Agreement, the client confirms that they have read, understood, and agree to be bound by the Terms & Conditions referenced above, which are incorporated herein by reference.
